Lobby Day: Protecting Workers From Misclassification as an Independent Contractor

Secretary-Treasurer Don E. Garcia, Business Agents Mike Hughes and Nick Berry joined forces with California labor leaders yesterday to protect the Dynamex decision by speak with assembly members and senators in Sacramento. The Dynamex decision, which was issued in April by the California Supreme Court, introduces the “ABC Test” which determines an employee’s status to stop the  misclassification of workers as independent contractors. The Dynamex Decision implements an enforceable evaluation that would protect many workers from being stripped of their labor rights. Misclassification of workers as independent contractors is heavily used and abused in the “gig economy” and all labor activists came to the forefront on Lobby Day to inform California’s assembly members and senators to not ignore this common issue that deteriorates the rights of workers, makes the job market more competitive, and endangers union work.
